By accessing or using Tally for Cal'ies ("Tally," "the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes your acceptance of the updated Terms.
Tally for Cal'ies is a mobile and web application that provides calorie and nutrition tracking features, including but not limited to: photo-based meal recognition, macro and micronutrient tracking, diet preset management, and AI-powered coaching ("Mira").
The App is intended for general wellness purposes only. It is not a medical device and should not be used as a substitute for professional medical, dietary, or nutritional advice.
To use Tally, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 13 years of age to create an account. By registering, you represent that you meet this age requirement.
Monthly and yearly subscription plans are billed in advance. A 7-day free trial is offered on both plans. Your payment method will not be charged until the free trial period ends. You may cancel at any time before the trial ends without charge.
After the trial period, your subscription will automatically renew at the applicable rate ($7.99/month or $47.99/year for launch pricing) until you cancel. Prices may change with 30 days' advance notice. The yearly launch pricing of $47.99 applies for the first year only; subsequent yearly renewals will be charged at the standard rate of $79.99/year unless you cancel before renewal.
The Early, Lifetime Access Plan is a one-time payment of $199 that grants lifetime access to all current and future Premium features. The following conditions apply:
"Lifetime Access" (also referred to as a "Lifetime Subscription") means access to the App for the operational lifetime of the App — that is, the duration for which we, in our sole discretion, continue to offer and support the App in its current or any modified form. It refers to the lifetime of the product, and not to the natural life of the subscriber, the life of any successor, or any minimum or guaranteed period beyond what we choose to provide.
Lifetime Access is personal to the original subscriber and is non-transferable. We make no representation or warranty regarding how long the App will remain available or supported. Lifetime Access does not create any perpetual obligation on us or our successors to maintain the App indefinitely.
You may cancel your subscription at any time through your account settings or by contacting us at help@tallyforcalies.com. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial billing periods. Lifetime Access purchases are non-refundable as described in Section 4.2 and are also subject to the discontinuation terms in Section 9.

The nutritional information and Dietary coaching provided by Tally are for informational and general wellness purposes only. Tally is not a licensed medical provider. Always consult a qualified healthcare professional before making significant changes to your diet, especially if you have a medical condition, are pregnant, or are taking medication.
Calorie estimates from photo recognition are approximations and may not be 100% accurate. Do not rely solely on Tally for medical or clinical nutritional decisions.
All content, features, and functionality of the App — including but not limited to text, graphics, logos, and software — are owned by Tally for Cal'ies and are protected by applicable intellectual property laws.
You retain ownership of any personal data you input into the App, subject to the terms of our Privacy Policy.
To the maximum extent permitted by law, Tally for Cal'ies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or inability to use the App, even if advised of the possibility of such damages.
Our total liability to you for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms creates a perpetual obligation on us or our successors to maintain the App indefinitely. With respect to Lifetime Access specifically, our liability for any claim related to a Lifetime Subscription is strictly limited to the amount the subscriber actually paid for that subscription (if any), and we shall not be liable for any indirect, consequential, or punitive damages, including loss of access or expected benefits. In the event of the owner's death or the dissolution of the business, the App may be discontinued without further liability, and any related obligations terminate automatically.
We reserve the right, in our sole discretion, to modify, suspend, discontinue, or terminate the App (or any part of it), including any Lifetime Access, at any time and for any reason, including but not limited to:
If the App is terminated or discontinued, subscribers with Lifetime Access will have no ongoing claim, right to access, refund, or damages against us, our owners, successors, or assigns, except as required by applicable law. We will make reasonable efforts to provide advance notice where feasible, but are not obligated to do so. Upon termination, any prepaid fees are non-refundable, and we have no further obligation to provide access, support, or alternative services.
Either party may also terminate this agreement: you may cancel your subscription via your account settings or by contacting help@tallyforcalies.com as described in Section 4.4, and we may terminate or suspend your access immediately for any breach of these Terms or for any of the reasons described above.
These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
